Madras HC quashes temple fund misappropriation case against three HR&CE staff in Tamil Nadu

The Madras High Court quashed the temple fund misappropriation case against three HR&CE staff, saying there was no oral or documentary evidence showing any specific role by them.

The case involved allegations of forged bills for temple festival expenses at Suchindram between 2004 and 2006. The court noted that witness statements pointed to the first accused as the person who prepared the bills and records, while the petitioners were not shown to have directly fabricated bills or misappropriated funds.

The court also observed that shop owners whose names were used in the bills said the bills were not issued by their shops. Even so, it found no material linking the three petitioners to the alleged wrongdoing and therefore quashed the proceedings against them.

Temple funds must be protected. But punishment must rest on proof, not assumption.
